1. Platform Description
GastroMindAI ("the Platform") is a restaurant promotion and menu analytics tool operated by GastroMind AI at GastroMindAI.com. The Platform allows restaurant operators to manage marketing campaigns, publish content to Facebook and Instagram via the Meta Graph API, track menu performance, and generate promotional materials.
2. Acceptance of Terms
By registering for or using GastroMindAI, you agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform.
3. Eligibility
You must be at least 18 years old and operate a legitimate restaurant or food service business. By using the Platform you represent that all information you provide is accurate and current.
4. User Responsibilities
- You are solely responsible for all content you publish through GastroMindAI, including posts, promotions, menu descriptions, and images.
- You must ensure that content you publish complies with applicable laws, Meta's Community Standards, and any applicable advertising regulations.
- You must not use the Platform for spam, misleading content, illegal promotions, or any activity that violates Meta's Platform Policies.
- You are responsible for maintaining the security of your account credentials.
- You must only connect Meta accounts that you own or have explicit authorization to manage.
5. Meta Platform Integration
The Platform integrates with Facebook and Instagram through the Meta Graph API and the Meta Platform Terms. By connecting Meta you authorize GastroMindAI to use only the permissions you approve, including public_profile, email, Page, Instagram, Ads and Catalog permissions needed for publishing, messaging, analytics, ads and catalog sync. Data flow: Meta sends account IDs and access tokens to GastroMindAI; we encrypt tokens, store IDs in Supabase, use them only for enabled features, and delete/revoke them when you disconnect or use /data-deletion.
6. No Liability for Published Content
GastroMind AI acts solely as a technical intermediary. We are not responsible for the accuracy, legality, or appropriateness of any content published by restaurant users through the Platform. Any liability arising from published content lies solely with the restaurant operator who published it.
7. Account Suspension and Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms of Service.
- Violate Meta's Platform Policies.
- Are used to publish spam, illegal, or harmful content.
- Engage in fraudulent or abusive behavior.
- Remain inactive for more than 24 consecutive months.
We will provide reasonable notice prior to suspension unless required to act immediately for security or legal reasons.
8. Subscription and Payment
GastroMindAI may offer free and paid subscription tiers. Specific pricing, billing cycles, and refund policies will be published on the pricing page at GastroMindAI.com. Subscriptions automatically renew unless cancelled before the renewal date. We reserve the right to modify pricing with 30 days' notice.
9. Intellectual Property
You retain all ownership of content you create and publish through GastroMindAI. By using the Platform, you grant GastroMind AI a limited license to store and transmit your content solely for the purpose of providing the service. We retain all rights to the GastroMindAI software, interface, and technology.
10. Disclaimer of Warranties
The Platform is provided "as is" and "as available." We do not guarantee uninterrupted, error-free service. We are not liable for any marketing outcomes, reach, or revenue generated or lost as a result of using the Platform.
11. Limitation of Liability
To the maximum extent permitted by law, GastroMind AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of revenue, loss of data, or reputational harm.
12. Governing Law
These Terms are governed by the laws of Switzerland. Any disputes shall be resolved exclusively in the courts of Switzerland, unless otherwise required by applicable consumer protection law.
13. Changes to Terms
We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. We will notify users of material changes via email or in-app notification.

Mit der Verbindung erlauben Sie nur die genehmigten public_profile, email, Page-, Instagram-, Ads- und Catalog-Berechtigungen fuer aktivierte Funktionen. Datenfluss: Meta sendet IDs und Tokens; wir verschluesseln Tokens, speichern IDs in Supabase und loeschen bzw. widerrufen sie beim Trennen oder ueber /data-deletion.
5. Keine Haftung für veröffentlichte Inhalte
GastroMind AI ist ein rein technischer Intermediär und übernimmt keine Haftung für die Richtigkeit, Rechtmäßigkeit oder Angemessenheit der veröffentlichten Inhalte.
6. Kontosperrung
Wir behalten uns das Recht vor, Konten zu sperren oder zu kündigen, die gegen diese Bedingungen oder die Meta-Plattformrichtlinien verstoßen.
7. Abonnement & Zahlung
Preise und Tarifdetails werden auf GastroMindAI.com veröffentlicht. Abonnements verlängern sich automatisch, sofern sie nicht vor dem Verlängerungsdatum gekündigt werden.
8. Geistiges Eigentum
Sie behalten das Eigentum an Ihren Inhalten. GastroMind AI behält alle Rechte an der Software und Technologie.
9. Geltendes Recht
Diese Bedingungen unterliegen dem Recht der Schweiz.

GastroMind AI agit uniquement comme intermédiaire technique et n'est pas responsable du contenu publié par les utilisateurs.
6. Suspension de compte
Nous nous réservons le droit de suspendre les comptes qui violent ces Conditions ou les Politiques de Meta.
7. Abonnement et paiement
Les tarifs sont publiés sur GastroMindAI.com. Les abonnements se renouvellent automatiquement sauf résiliation avant la date de renouvellement.
8. Droit applicable

7. Pretplata i plaćanje
Cijene i detalji pretplate objavljeni su na GastroMindAI.com. Pretplate se automatski obnavljaju ako se ne otkaže prije datuma obnove. Zadržavamo pravo promjene cijena uz obavijest od 30 dana.
8. Intelektualno vlasništvo
Zadržavate vlasništvo nad sadržajem koji kreirate. GastroMind AI zadržava sva prava na softveru i tehnologiji platforme.
